Within 24 Hours of an Injury

If you have suffered an injury at the fault of another, it is best to get the process rolling immediately. File a report with the police (if possible have the police come to the scene), get a medical examination as well as professional estimates for repairs to damaged property. Contact any applicable insurance companies (property or auto insurance) to file a claim within 24 hours of the accident. Also get the contact information for any witnesses who may have seen the accident occur.

What to Tell the Insurance Representatives

Soon after you file a claim with the at-fault person’s insurance, an insurance adjuster will call you. They may want to discuss the accident, your injuries and damages, or request a recorded statement. If you have already hired an attorney, refer the adjuster to your attorney. Do not give the adjuster a statement as it can be used against you for your settlement.

If you do not yet have an attorney, write down the adjuster’s name, number, and insurance company. You should still not give them a statement, but tell the adjuster that you are gathering the necessary reports for the claim. Ask them how they would like documentation sent to them, so you can start sending them copies of medical bills, estimates for damage repairs, and proof of lost wages.
